IN a controlled envornment such as a track, brakes are not necessary. However in a public and often crowded area, brakes may not be necessary either, but they do offer a cushion for safety, just in case you can't stoop with your legs, just in case. How could it hurt. I feel it's more of an ego issue than an issue of whether or not they belong. Bikes need brakes to prevent an accident. But I can understand why seasoned fixed gear riders don't want them, they are used to riding without them.
In this case I say too each his own. I ride with and without. Is this really worth a judge to rule on.......I mean fucking come on man, no brakes on yer bike and your in fucking court!!! WTF!! I would be so pissed.

if you get hit by traffic cuz you couldn't stop in time,
you needed brakes,
but by then it's probably too late,
you probably need life insurance, health insurace. and a good surgen.
but i'm not the saftey nazi tellin you to put a brake on your bike, or wear your helmet.

When kids uner 15 come into my shop with BMX bikes sansa brakes and ask me to fix something, usually a flat, or they didn;t install their new mail order headset correctly...I tell them it needs a brake or I have to put one on....PA. requires one functioninng brake or their is a huge liability hanging over my head...I have no choice in those situations. But given personal choice. I don;t always wear a helmet either, but I do like having brakes on my bikes, they keep me out of the hospital, and my insurance premiums down.
I totaly forgot about that,
yeah, back in the day working at cycle works we wouldn't work on a kids bike if it didn't have brakes,
you get yourself and the shop in trouble if the kid comes in with no brakes and a flatt, fix his flat, send him back out and he gets killed in traffic, and has a bike shop reciept in his pocket,
next guy through the door after the cop and the parents is gonna be the lawyer...
